Terms and conditions

Delivery: Our carriers are authorised to deliver only when a signature for receipt is available. However where specific instructions are given to leave wine without a signature being obtained, or to leave the consignment at another address other than that of the customer, Laytons cannot accept responsibility for loss or damage arising as a result of carrying out those instructions. Orders of over £250 ex VAT or comprised of 4+ cases will delivered free otherwise a delivery charge of £15 ex VAT will be applicable.

Payment: The buyer should pay for the goods immediately upon placing the order. Where the buyer has an approved credit account they should pay the price of the goods on the 20th day of the month following the month in which the goods were invoiced.

Liability: Customers are requested to carefully check all goods at the time of delivery. The delivery or carrier's note should be signed noting any shortages or breakages. We regret we cannot accept claims for shortages or breakages not recorded in this way. In any case claims must be made to the sales support team within three days of delivery.

Sale or Return: A sale or return service is available. Stock must be returned within 30 days of the original delivery date. Wines must be returned in their original cases, undamaged and unopened - only full cases can be returned. No mineral water, beers or spirits can be returned. Returned goods will be subject to inspection by Laytons. Collection charges will apply.

Title: The goods shall remain the seller's property until the buyer has paid all sums due from the seller. Until that time, the buyer shall hold them as bailee, store them in such a way as they can be identified as the seller's property. The goods remain the seller's property until they are paid for, they shall be at the buyer's risk from time of delivery and the buyer shall insure them against loss or damage accordingly, and in the event of such loss or damage shall hold the proceeds of such insurance on behalf of the seller as trustee for the seller. In accepting delivery of the goods the buyer undertakes to indemnify the seller against any losses and expenses incurred by the seller, arising from the buyer's breach howsoever caused.

Price: The price of the Goods shall be the price stated in the Seller's quotation or such other price as expressly agreed by the Seller and the Buyer. In the event of the price not being fixed the price of the Goods shall be the price listed in the Seller's published list current at the date the contract is made.

Variation: The seller has the right to alter the foregoing Terms and Conditions at any time by giving one month's notice in writing. E&OE February 2010.

In these Conditions of Sale:

"The Seller" means Laytons Wine Merchants Limited.

"The Buyer" means the person who buys or agrees to buy the goods from the Seller.

"The Goods" means the goods which the Seller is to supply in accordance with these Terms and Conditions of Sale.
